Acceptable Use Policy

Buy Moonshot, Inc. (“Moonshot”, “we”, or “us”) provides a platform that allows users to view and interact with Digital Assets, including Memecoins, and to launch their own Memecoins (collectively, the “Services”). This Acceptable Use Policy (“Acceptable Use Policy”) supplements our Terms of Use (the “Terms”) and applies to all users, user generated content, and user activity in connection with the Services. This Acceptable Use Policy is designed to protect us, our users, and the general Internet community from unethical, harmful, irresponsible, illegal and other prohibited activity. Any capitalized terms not defined herein shall have the meanings set forth in the Terms.

Prohibited Content

To maintain a safe and respectful environment, the following content is strictly prohibited in connection with the Services:

• Infringing Materials: Any content that infringes any intellectual property rights of a third party. You should only share content that you own, or that you otherwise have rights to or are authorized to share through the Services. If you make content available through the Services that you do not own or otherwise do not have the rights to share through the Services, you may be infringing another person’s intellectual property rights. This includes any third party content included in your content, derivative creations, or performances of others’ copyrighted content. We encourage you to assess your content for adherence to applicable intellectual property laws and the proper application of principles such as fair use, and to secure all appropriate rights needed, before sharing your content through the Services.
• Sexual and Potentially Obscene Content: Any content that depict sexually explicit activities or acts, including intercourse, are prohibited. Content that focuses on extreme or gratuitous gore and violence are also prohibited. Content or activities that threaten or promote sexual violence or exploitation of any individual, including but not limited to minors (e.g. CSAM), are strictly prohibited and may be reported to law enforcement.

• Hate Speech: Any content that attacks or demeans individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics is not allowed.

• Physical Harm: Any content that may promote or encourage any physical harm is prohibited. This includes, but is not limited to: suicide threats, intentional physical trauma, illegal use of drugs, illegal or dangerous consumption of alcohol, and dangerous or distracted driving.

• Non-Consensual Sexual Content: Including revenge porn, creepshots, or upskirt images.
• Fraudulent or Deceptive Content: Any content intended to mislead, deceive, or defraud others is strictly prohibited. This includes but is not limited to phishing attempts, pump-and-dump schemes, impersonation of other individuals or entities, or the dissemination of false or misleading information designed to manipulate users. Mass solicitation, repetitive or irrelevant content, and the creation of accounts to artificially inflate popularity or trading volume are also prohibited.

Prohibited Activities

In addition, you may only use our Services for lawful purposes. Without limiting the foregoing, you will not use our Services, directly or indirectly, to:

• Infringe or violate any copyright, trademark, service mark, patent, right of publicity, right of privacy, or other proprietary or intellectual property rights of a third party;
• Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service;
• Violate any applicable local, state, national, or international law, or any rule, guidance, or regulations having the force of law (“Laws”);
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity (including but not limited to Moonshot);
• Harvest or collect email addresses or other contact information of other users from the Service by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
• Engage in activity that seeks to defraud us or any other person or entity, including, but not limited to, providing any false, inaccurate, or misleading information in order to unlawfully obtain the property of another;
• Engage in activity that violates any Laws concerning the integrity of trading markets, including, but not limited to, the manipulative tactics commonly known as “rug pulls”, pumping and dumping, and wash trading;
• Engage in activity that violates any Laws concerning the trading of securities or derivatives, including, but not limited to, the unregistered offering of securities and the offering of leveraged and margined commodity products to retail customers in the United States or other applicable jurisdiction. Without limiting the foregoing, you will not represent or state that (a) any Memecoin is to be used for any purpose other than entertainment or social interaction; (b) there is any reasonable expectation of profits derived from the efforts of others in connection with any Memecoin; or (c) any Memecoin would entitle an individual to future income or assets of any person.
• Further or promote any criminal activity or enterprise or provide instructional information about illegal activities;
• Obtain or attempt to access or otherwise obtain any content or information through any means not intentionally made available or provided for through the Service;
• Circumvent, remove, alter, deactivate, degrade, or thwart any of the content protections in or access or geographic restrictions on any content available on or through the Service, including through the use of virtual private networks, Tor or other similar technologies; or
• Engage in or use any data mining, robots, scraping, or similar data gathering or extraction methods.

Prohibited Persons

Our Services may not be used in connection with, or for the benefit of, or otherwise permit access to the Services by, any country, government, organization, entity, or person that is restricted by the U.S. Treasury Department’s Office of Foreign Asset Control, or otherwise prohibited by applicable Laws.

Without limiting the foregoing, you may not use the Services if you are located in the following countries: Afghanistan, Albania, Algeria, Angola, Azerbaijan, Bangladesh, Belarus, Benin, Bhutan, Botswana, Brunei Darussalam, Bulgaria, Cambodia, Cameroon, Cape Verde, Central African Republic, Chad, Congo (Brazzaville), Congo (Kinshasa), Côte d’Ivoire, Cuba, Djibouti, Ethiopia, Gabon, Gambia, Georgia, Ghana, Haiti, Iran, Iraq, Kazakhstan, Korea, North, Kosovo, Kyrgyzstan, Lebanon, Liberia, Libya, North Macedonia, Madagascar, Malawi, Maldives, Mali, Micronesia, Mongolia, Mozambique, Myanmar, Nauru, Nepal, Nicaragua, Niger, Pakistan, Russian Federation, Rwanda, Sao Tome and Principe, Seychelles, Sierra Leone, Somalia, South Sudan, Sri Lanka, Sudan, Swaziland, Syria, Tajikistan, Tanzania, Tonga, Tunisia, Turkmenistan, Uganda, Ukraine, Uzbekistan, Vanuatu, Venezuela, Yemen, Zambia, and Zimbabwe.

Enforcement

We reserve the right to investigate any suspected violation of this Acceptable Use Policy. In response to a violation or suspected violation, we may take any action we deem appropriate in our sole discretion, including but not limited to:

1. Content Removal: Removing or disabling access to any content or material (including but not limited to any Memecoin) that violates this Acceptable Use Policy.

2. Account Suspension or Termination: Suspending or permanently terminating user accounts involved in the violation.

3. Access Restrictions: Limiting or revoking access to certain portions of the Services.

4. Legal Action: Initiating civil or criminal proceedings where appropriate, including reporting matters to law enforcement or other relevant authorities.

5. Notification: Notifying impacted parties, regulators, or other third parties where required by law or contract.

6. Remediation Requirements: Requiring you to take specified actions to remedy a violation as a condition of continued access to the Services.

We may exercise these rights with or without notice to you, and without any obligation to refund any amounts previously paid. Enforcement decisions are made at our sole discretion and are not subject to appeal.

Changes

We reserve the right to modify this Acceptable Use Policy at any time by publishing the revised version on our website. The revised version will be effective on posting.
